  • New supreme court ruling

    I would be interested to hear everyone's take on the Supreme Court ruling that corporations have unlimited access to politicians and can spend as much money as they want, and basically threw out some of the rules on campaign finance reform.


    Why do corporations have rights of persons?

    The legal terms "person" or "persons" generally include corporations. Corporations are a legal entity that allows the creation of artificial persons who have many of the same rights, privileges, and obligations as real people do. When an organization is incorporated , it is made a part of (or more literally, added into the body of) the state in which it is registered and the Articles of Incorporation are filed.

    The role of corporations in American law may go deeper than any of us know. Some have made some interesting and persuasive arguments that the government has been dealing with individual American citizens as corporations since 1933 when Congress amended the Trading With The Enemy of 1917 (codified in Title 50 Appendix--War and National Defense). The Emergency Banking Relief Act of March 9th 1933 amended TWEA by removing verbiage (a few key words, really) which prohibited the law from being applied to American citizens. It also made changes to Title 5, Banks and Banking.

    Whether or not we are treated as corporations, we are definitely treated as "enemies," for some purposes, since the whole basis of our money system is now the power of the federal gov't and states to "confiscate" all of our property--including our labor. This fact was recorded in the minutes of Congress, when the Act was being discussed. I think it is significant that the Federal Reserve forwarded the Act to FDR who ran it through Congress like an All-Star. Essentially we became enemies of the State because too many of us were demanding our money (gold) in return for their gold certificates.

    I'm venturing out on a limb here, but if it's true that we are all basically incorporated, then the SCOTUS' decision could have affected the rights of individuals to make contributions as well.

      I would say the Liberials have the union money and now the republicans have the corporations money.

        I argue the point that a corporation that is incorporated and brought to life under state laws, is not a living entity that breathes and bleeds, so how does it have the rights of an individual.
        1 Person 1 vote, i don't see this doing our democracy/republic any good as,,,,,we the citizens can not compete against the huge amounts of money and influence that a corporation can put forward.

          For that matter, we as individual peons cannot compete with the huge amounts of money that some individuals put forward.

          I supposed what peons could do is create a corporation for the purpose of advancing our interests. It could be a nonprofit, like the :poop:Sierra Club:poop:. Thing is most all "grass roots" organizations are actually started and manipulated by bigger interests (like civil service unions) to advance their agendas.

            I would argue for publicly funded elections, everyone contributes $10.00,,,,,,
            multiply by the 110 +/- million or so voters, and you have plenty of money to fund a public campaign. Thus no outside influence.

                Chip,

                We have the First Ammendment. We have the individual right to free speech as well as the right of a group of us to speak or minds. Whether we speak as a union, religious group or a company, we can exercise our right to speak. We can also speak with our check book if we like.

                    yes I did read the First Amendment.,,,,,,,,and the founding fathers wrote about we the people, not we the corporations.
                    I still believe in the long run this will be bad for the election process, that was/is totally out of hand.
                    Time will tell.
