  • MAJOR ALERT! Blair Holt's Firearm Licensing and Record of Sale Act of 2009 (HR 45)

    Wow! This is serious! I mean really serious! If anyone needs a history lesson on why this is important, just let me know. I'm figuring ya'll know what this means....

    Amends the Brady Handgun Violence Prevention Act to prohibit a person from possessing a firearm unless that person has been issued a firearm license under this Act or a state system certified under this Act and such license has not been invalidated or revoked. Prescribes license application, issuance, and renewal requirements.

    Prohibits transferring or receiving a qualifying firearm unless the recipient presents a valid firearms license, the license is verified, and the dealer records a tracking authorization number. Prescribes firearms transfer reporting and record keeping requirements. Directs the Attorney General to establish and maintain a federal record of sale system.

    Prohibits:
    (1) transferring a firearm to any person other than a licensee, unless the transfer is processed through a licensed dealer in accordance with national instant criminal background check system requirements, with exceptions;
    (2) a licensed manufacturer or dealer from failing to comply with reporting and record keeping requirements of this Act;
    (3) failing to report the loss or theft of the firearm to the Attorney General within 72 hours;
    (4) failing to report to the Attorney General an address change within 60 days; or
    (5) keeping a loaded firearm, or an unloaded firearm and ammunition for the firearm, knowingly or recklessly disregarding the risk that a child is capable of gaining access, if a child uses the firearm and causes death or serious bodily injury.
    Prescribes criminal penalties for violations of firearms provisions covered by this Act.
    Directs the Attorney General to:
    (1) establish and maintain a firearm injury information clearinghouse;
    (2) conduct continuing studies and investigations of firearm-related deaths and injuries; and
    (3) collect and maintain current production and sales figures of each licensed manufacturer.
    Authorizes the Attorney General to certify state firearm licensing or record of sale systems.

    Wow! The links on that web site take you to some disturbing places. Are there really that many people out there that don't know the reality of this issue? There is one site that lists all the court cases ongoing that include murder with a deadly weapon (fire arms) but I kept reading and there are numerous cases of murder with knives, beatings, autos, you name it. So why is the fire arm the only thing getting controlled or banned? What about knives, baseball bats and cars? Unbeleivable...

      This is incredible... Bad thing is with the Dems in control of both houses and the White House, this thing might actually pass.

      I was (not by my wanting) watching Obama's press conference this morning where he was talking to all the "Labor Leaders" in the US... I wonder if all the "laborers" are aware of this? I doubt it very much!

      I am originally from Alabama... I know the vast majority of "laborers" in Alabama would be opposed to this!!! We have to get this word out!

      Thanks Sarah for bringing this to the front!
      Regards,
      Randy

          Response from the NRA...

          All, here is the response I received from the NRA when I contacted them for their position on this legislation...

          Dear Randy,

          Thanks for contacting NRA-ILA.

          HR 45, although a registration scheme, does not pose an immediate threat. Many bills are introduced with full knowledge that they will not go anywhere.

          If the anti-gunners in the U.S. Congress begin pushing for this bill, we will use all of our power and influence to prevent its passage. As of now it has only a sponsor, without any co-sponsors. It is in a committee and is not up for a vote.

          We'll keep everyone posted at www.nraila.org and in our magazines.

          Sincerely,

          Krista Cupp

              That NRA response is typical, I think. After all, they endorsed McCain after giving him a C+ rating on gun laws! Yes, I wrote them a long letter, to which they responded, (in so many words) "he's better than Obama." Can you get any more pathetic?

              If you want to join an organization that is REALLY fighting for your rights, look into Gun Owners of America for some no-compromise action!
