Sacramento, CA; July 17, 2012: On behalf of off-road motorized recreational users of the Tahoe National Forest, attorneys with Pacific Legal Foundation today sued the federal government for illegally closing off more than 800 miles of roads and trails that have been used for decades by the public for environmentally responsible off-road motorized recreation, access to camping and fishing, and to assist in the prevention of forest fires.
Not sure why CORVA, CA4WD, BRC, U4WD or anyone else has done this yet.

BRC and CA4WDC are not lining their own pockets.
Both have their own budget issues that they are working though.
UFWDA has had their own issues with budget concerns a while back.
It takes money to file a lawsuit, and you hope you can win, or have an outcome that is favorable for your group.

Membership in these organizations has been dropping in the last few years. This membership drop puts a hinderance on keeping a legal team handy to file and review cases for our cause.

So, please join what you can afford to join, starting with your local clubs, state association and then the national level.

The greenies are reimbursed by the government for every hour of their lawyers time win or lose. It should be the same for our lawyers.

They actually only get reimbursed if they win, or the government agency settles and the green group drops their lawsuit. If they lose, they get nothing.

              That is not completely true.

Parties are considered to be prevailing parties when they have been successful on any significant issue in litigation that achieves some of the benefit the parties sought.

Also most government agencies have 90 days to respond to lawsuits. If they miss the deadline the government pays the lawyers fees. They miss the deadline a lot.

Google "Equal Access to Justice Act"

We need to use this resource before we loose it. Turn it on the greenies and give them a taste of their own underhandedness.
